Terms of Service
Last updated: 6 September 2026
1. Who we are and what these Terms cover
1.1. These Terms of Service ("Terms") govern the use of the TellTourer web application (the "Service"), available at telltourer.com and the self-guided audio tours accessible through it (each a "Tour"), provided by TellTourer OÜ, registered in Estonia, registry code 17493478, with its registered office at Leevikese 1a-7, 50413, Tartu, Estonia, e-mail [email protected] ("we", "us", "our").
1.2. Access to a Tour is purchased through a distribution partner ("Distribution Partner"). The purchase, including payment, confirmation, and cancellation before the access code ("Code") is used, is governed by the Distribution Partner's terms and the cancellation policy shown on the Tour listing. Purchasers must comply with those terms. These Terms govern the Service itself: the redemption of Codes, the playback of Tours, and your use of the web application. We are the supplier of the Tour service.
1.3. By entering a Code in the Service you accept these Terms. Acceptance is requested on the code-entry screen before a Tour is unlocked. If you do not accept these Terms, do not use the Service.
2. Use of the Service
2.1. No user account is required. A Tour is unlocked by entering a valid Code ("Redemption").
2.2. The Service is intended for purchasers of Tours and the people travelling with them. Codes are purchased through a Distribution Partner by adults; younger travellers may listen under the responsibility of the purchaser. Users must be at least 13 years old to use the Service on their own device.
2.3. You are responsible for keeping your Code confidential. A Code functions like a ticket: anyone who has it can unlock the Tour.
3. Codes, redemption, and access
3.1. Code validity. A Code is valid for Redemption for 12 months from the date of purchase. The validity period is also stated on the Tour listing before purchase. An unredeemed Code expires at the end of this period.
3.2. Access Window. Once redeemed, a Tour is accessible for the period stated on the Tour listing, counted from the first Redemption (the "Access Window"). Playback requires an internet connection; the Service may cache content for temporary offline playback where your browser supports it, but offline availability is not guaranteed.
3.3. A Code is for the personal use of the purchaser and the people travelling with them. We may limit the number of devices a Code can be used on, or suspend a Code that is shared beyond this.
3.4. Discontinued or materially changed Tours. If we withdraw a Tour, or change it in a way that materially reduces its value, while unredeemed Codes for it remain valid, you may choose between: (a) a substitute Tour of equivalent value, where one is available; or (b) a refund of the purchase price, processed through the platform where the purchase was made. Contact us at [email protected] and we will arrange your chosen remedy. We may correct or improve a Tour at any time at no cost to you. If we withdraw a Tour or materially reduce its value during your Access Window, the same remedies apply.
4. Cancellations and refunds
4.1. Before Redemption, cancellations and refunds are handled by the Distribution Partner through which the purchase was made, under its refund process and the cancellation policy displayed on the Tour listing at the time of purchase.
4.2. After Redemption, the Tour is treated as delivered. This does not affect the remedy in Section 3.4 or your statutory rights, including rights under EU and national consumer law in respect of digital content that is defective or not as described.
4.3. Nothing in these Terms limits or excludes your statutory consumer rights.
5. Your licence and acceptable use
5.1. Upon Redemption we grant you a limited, non-exclusive, non-transferable licence to play the Tour for personal, non-commercial use during the Access Window.
5.2. The Tours and the Service are our intellectual property or are licensed to us. You may not: copy, record, redistribute, publicly perform, resell, or commercially exploit any Tour content or any part of the Service; share, publish, or resell Codes; scrape or extract content by automated means; circumvent the Service's security or access controls, including the Access Window; reverse engineer the Service except to the extent permitted by mandatory law; use the Service for any unlawful purpose; or impose an unreasonable load on our infrastructure.
5.3. A breach of this Section may result in suspension of access, without prejudice to your statutory rights.
6. Third-party services
6.1. The Service uses mapping services provided by Mapbox. By using the Service you acknowledge and agree to be bound by the Mapbox Terms of Service and Mapbox Privacy Policy with respect to the map features. Map data and positioning are provided by Mapbox and are subject to its availability.
7. AI-assisted content
7.1. Tour scripts are drafted with the assistance of artificial-intelligence tools and are reviewed and edited by our team before publication. Tour narration is generated using text-to-speech (AI voice) technology; the voices you hear are synthetic.
8. Self-guided use, safety, and devices
8.1. Tours are self-guided. While following a Tour, stay aware of your surroundings, obey traffic rules, respect public and private property, and comply with local laws and any instructions of authorities or venue staff. You are responsible for your own safety and belongings.
8.2. GPS positioning is approximate, and routes may be affected by road closures, construction, public events, weather, or other local conditions. Tour information such as historical details, opening hours, prices, and accessibility may contain errors or become outdated; please verify important details directly with the attraction.
8.3. The Service requires a smartphone with a modern web browser and an internet connection. Supported browsers: current versions of Safari, Chrome, Firefox, and Edge. You are responsible for keeping your device charged and for any mobile-data or roaming charges.
9. Liability
9.1. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for damage caused intentionally or through gross negligence, or for any other liability that cannot be excluded or limited under applicable law.
9.2. Subject to Section 9.1, we are not liable for indirect or consequential losses, loss of profit, or loss of data arising from the use of the Service or a Tour.
9.3. Subject to Section 9.1, our total liability arising from or in connection with a Tour is limited to the price paid for that Tour.
9.4. We do not guarantee that the Service will be uninterrupted or error-free, but this does not affect your statutory rights in respect of digital content and services.
10. Changes to these Terms
10.1. We may amend these Terms for valid reasons, such as changes in law, changes to our services, or security requirements. Amended Terms will be published on the Service with at least 14 days' notice and a summary of the changes. A Code purchased before an amendment remains governed by the version of the Terms in force at the time of purchase, unless the change is required by law or is more favourable to you.
11. Privacy
11.1. How we process personal data is explained in our Privacy Policy.
12. Governing law and disputes
12.1. These Terms are governed by Estonian law. If you are a consumer residing in another country of the European Union, you additionally benefit from any mandatory protections of the law of your country of residence, and nothing in these Terms deprives you of those protections or of your right to bring proceedings in the courts of your country of residence.
12.2. If you are a consumer, you may submit a complaint to us at [email protected] first; we aim to respond within 14 days. You may also use out-of-court dispute resolution: in Estonia, the Consumer Disputes Committee (Tarbijavaidluste komisjon) operating at the Consumer Protection and Technical Regulatory Authority (TTJA, www.ttja.ee).
